An application under section 11 of the Act for the appointment of an arbitrator is governed by section 137 of the list of the Statute of Limitations 1963 and must be made within three years from the date on which the right of application is first created. However, there is no right of claim until the defendant can destroy that right in a clear and unambiguous manner. It must therefore be clear that the right to arbitration must be made as soon as the reason for arbitration arises, as in the case of a plea based on a civil action. So there must not be only a right to money, but there must be a difference or a dispute must occur. An application submitted on the expiry of a period of three years from the date of acceptance of the final account and the survey shall be time-barred.
